Perth & Kinross Council's decision on the Glenlyon Estate track
We have now received the Closing Report from Perth & Kinross Council on their enforcement case into the work done to the track in Glenlyon Estate without planning permission. The Council have concluded that there has been ‘no breach of Planning Control’.
The Council have decided that the work done amounted to ‘maintenance’ rather than ‘alteration’ of the track which means that the developer wasn’t required to notify and get permission before conducting the work. We are disappointed by the Council’s decision which we are concerned sets a worrying precedent and could lead to unforeseen adverse impacts for the wild and sensitive upland areas in Perth and Kinross.
The case highlights some of the issues the Scottish Environmental Link Hilltracks campaign has identified with the use of Prior Notifications for hilltracks and has been working to change.
